1. Introduction

These Terms of Service ("Terms") govern access to and use of the ParkGuest platform, websites, applications, and related services operated by:

By accessing or using ParkGuest, you agree to be bound by these Terms.


2. Definitions

"ParkGuest" means the software platform and services provided by Onni & Co GmbH.

"Parking Operator" means the individual or entity legally authorized to manage, control, or administer a parking area.

"Business User" means a registered organization, company, housing association, property manager, hotel, restaurant, parking operator, or other entity using ParkGuest.

"Driver" means a person using a parking location managed through ParkGuest.

"Administrative Fee" means a contractual charge or administrative cost issued in connection with violations of parking rules established by a Parking Operator.


3. Nature of the Service

ParkGuest provides a software platform that enables Parking Operators to:

  • Manage parking locations;
  • Configure parking rules;
  • Register visitors;
  • Issue permits and authorizations;
  • Collect parking fees;
  • Monitor parking activity;
  • Report parking rule violations;
  • Administer parking-related communications and enforcement processes.

ParkGuest acts solely as a technology platform, payment processor, and administrative service provider.

Parking Agreement

Any parking agreement is concluded directly between:

The Driver and The Parking Operator

ParkGuest is not the owner, lessor, operator, or provider of parking spaces unless expressly stated otherwise.


4. Business Accounts

Business Users must:

  • Be at least 18 years old;
  • Have legal authority to act on behalf of the organization;
  • Provide accurate information;
  • Maintain secure login credentials;
  • Comply with applicable laws.

Business Users are responsible for all activity occurring under their account.


5. Company Verification

ParkGuest may obtain company information from public sources, including commercial registers and government databases.

By registering an organization through ParkGuest, the user confirms that they are authorized to represent and manage that organization on the platform.


6. Parking Rules and Signage

The Parking Operator is solely responsible for:

  • Establishing parking rules;
  • Determining parking conditions;
  • Determining parking prices;
  • Ensuring compliance with applicable laws;
  • Maintaining proper signage at the parking location.

ParkGuest may provide signage templates or physical signage products containing:

  • Parking rules;
  • Property information;
  • Contact information;
  • Administrative fee information;
  • QR codes and payment instructions.

The Parking Operator remains responsible for ensuring signage is properly displayed and legally compliant.


7. Parking Fees

Parking fees are determined by the Parking Operator.

Before payment, Drivers will be presented with applicable pricing and parking conditions.

Payment of parking fees does not create a contractual relationship between the Driver and ParkGuest.


8. Administrative Fees and Parking Violations

Where permitted by applicable law and properly disclosed through signage, Parking Operators may establish administrative fees relating to parking rule violations.

ParkGuest may assist Parking Operators in:

  • Receiving violation reports;
  • Reviewing supporting evidence;
  • Verifying applicable parking rules;
  • Preparing administrative communications;
  • Processing payments;
  • Delivering notices.

Administrative fees are determined by the Parking Operator.

ParkGuest may charge additional processing fees relating to:

  • Administrative handling;
  • Research costs;
  • Printing;
  • Postage;
  • Personnel expenses;
  • Payment processing.

Applicable fees will be disclosed in accordance with applicable law and signage requirements.


9. Vehicle Owner Identification

Where legally permitted, ParkGuest may assist Parking Operators in obtaining vehicle owner information from competent cantonal authorities or other legally authorized sources.

Such requests may be performed manually or through legally permitted procedures.

Information obtained may be used solely for purposes connected with parking administration, enforcement, payment collection, dispute resolution, and compliance with applicable law.


10. Distribution of Administrative Fees

Administrative fees collected through ParkGuest may be distributed between:

  • The Parking Operator;
  • ParkGuest;
  • Other authorized recipients designated by the Parking Operator.

ParkGuest may retain a service fee and processing costs associated with enforcement activities.

The Parking Operator may determine whether a portion of the proceeds is shared with individuals who report violations.


11. Payments

Payments are processed through Stripe or other authorized payment service providers.

By making a payment, users agree to any applicable payment processor terms.

ParkGuest does not store full payment card information.


12. Holding of Funds

ParkGuest may temporarily hold parking fees, administrative fees, and related payments.

Unless otherwise agreed, funds may be distributed at the end of the applicable calendar month.

ParkGuest may delay distributions where necessary to:

  • Investigate disputes;
  • Prevent fraud;
  • Comply with legal obligations;
  • Resolve payment issues.

13. Subscriptions

ParkGuest may offer monthly and yearly subscriptions.

Monthly Plans

Monthly subscriptions remain active until the end of the current billing period after cancellation.

Yearly Plans

Yearly subscriptions remain active until the end of the current annual billing period after cancellation.

Unless cancelled, subscriptions may automatically renew.


14. Refunds

Subscription fees are generally non-refundable unless required by applicable law.

Parking fee refunds and administrative fee disputes shall be handled according to the applicable parking rules and legal requirements.


15. User Content

Users may upload:

  • Images;
  • Parking evidence;
  • License plate information;
  • Communications;
  • Reports.

Users warrant that they have the legal right to upload such content.

Users remain responsible for all uploaded content.


16. Intellectual Property

All rights relating to:

  • ParkGuest;
  • Software;
  • Branding;
  • Logos;
  • Content;
  • Databases;
  • Documentation;

remain the exclusive property of Onni & Co GmbH unless otherwise stated.


17. Acceptable Use

Users may not:

  • Use the platform unlawfully;
  • Upload false evidence;
  • Interfere with platform operations;
  • Access unauthorized accounts;
  • Circumvent security measures;
  • Misrepresent authority over parking locations.

18. Suspension and Termination

ParkGuest may suspend or terminate accounts at any time where:

  • These Terms are violated;
  • Fraud is suspected;
  • Legal compliance requires action;
  • Platform security is threatened.

19. Disclaimer of Warranties

The platform is provided "as is" and "as available."

ParkGuest does not guarantee:

  • Continuous availability;
  • Error-free operation;
  • Accuracy of third-party information;
  • Availability of governmental databases;
  • Availability of payment processors.

20. Limitation of Liability

To the fullest extent permitted by Swiss law, ParkGuest shall not be liable for:

  • Lost profits;
  • Lost revenue;
  • Business interruption;
  • Parking disputes;
  • Driver behavior;
  • Property damage;
  • Signage failures;
  • Incorrect parking information;
  • Delays in government responses;
  • Payment processor failures.

Nothing in these Terms excludes liability where exclusion is prohibited by law.


21. Indemnification

Business Users agree to indemnify and hold harmless Onni & Co GmbH from claims arising from:

  • Parking rules established by the Business User;
  • Improper signage;
  • Unlawful enforcement actions;
  • Violations of applicable law.

22. Changes to the Terms

ParkGuest may modify these Terms from time to time.

Updated Terms will be published on the website.

Continued use of the platform constitutes acceptance of the revised Terms.


23. Governing Law and Jurisdiction

These Terms shall be governed exclusively by the laws of Switzerland.

The exclusive place of jurisdiction for all disputes shall be Zug, Switzerland.
